  • 33 states require an update to their application to include sexual orientation and gender identity in the list of protected characteristics under federal law.   • CO - The Colorado employment application was updated to include carefully worded questions and required legal disclosures. The salary history question has also been removed.
  • VA - The Virginia employment application was updated to include additional protected characteristics based on recently passed laws prohibiting employers from discriminating on the basis of sexual orientation, gender identity, and status as a veteran.
  • CA - The California employment application was updated to include a scheduling question addressing the applicant's right to withhold information that may disclose religious creed, age, or medical condition.
  • NM - The New Mexico employment application was updated to include additional protected characteristics based on the recently passed law prohibiting employers from discriminating against pregnant women and new mothers in the workplace.
